Suffolk Traffic Agency Conviction Overturned
Pulled over in Suffolk County, New York? Traffic or Car Accident? Issued a ticket? Suffolk County Traffic Accident or Suffolk County Traffic Infraction - It is the Traffic Agency, the Suffolk County Traffic and Parking Violations Agency ("TPVA"), where some people first encounter law enforcement after an accident or a traffic stops.
Here, at the Suffolk County Traffic Agency, unfortunately, it is another school bus camera stop conviction that the Appellate Court reverses. The Suffolk County Traffic Agency, or the Suffolk TPVA, is reversed:
Appeal from a judgment of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency (Allen Mathers, J.H.O.), entered March 9, 2022. The judgment, after a nonjury trial, imposed a $250 civil liability upon defendant as the owner of a motor vehicle which had failed to stop for a stopped school bus.
Controversial as they may be, Suffolk County Accidents and Nassau County Accidents are allegedly avoided by the use of these New York Traffic Infractions. The local governments, Suffolk County, New York Traffic and Parking Violations Agency, argue that the issuance of such traffic violations deter future bad behavior. Here,
Defendant was served with a notice of liability pursuant to Vehicle and Traffic Law § 1174-a. The notice states that a vehicle owned by defendant had failed to stop for a stopped school bus on July 15, 2021, at 4:01 P.M., at 200 block of Old Country Road in Suffolk County, New York. At a nonjury trial, the video depicting the violation was reviewed by the court. The court found defendant liable and a judgment was entered imposing a $250 civil liability. Defendant appeals, and the People consent to a reversal in light of this court's decision in People v Croce (___ Misc 3d ___, 2023 NY Slip Op 23399 [App Term, 2d Dept, 9th & 10th Jud Dists 2023]).
The Case is People v. Seidenberg, 2024 NY Slip Op 50191 - NY: Appellate Term, 2nd Dept., 2024, The Second Department Appellate Term holds that the judgment is reversed, without costs, and the notice of liability is dismissed. Id. ("For the reasons stated in People v Croce (id.), the judgment is reversed and the notice of liability is dismissed").
