Extra Fees at Suffolk County TPVa - Speed & Traffic Tickets
If you have ever received a traffic or parking ticket returnable to the Suffolk County Traffic and Parking Violations Agency (TPVA) in Hauppauge, you may have noticed additional administrative or late fees on top of the base fine. In Ballato v. Suffolk County Traffic & Parking Violations Agency (2025 NY Slip Op 03789), the Appellate Division, Second Department, kept alive a challenge to several of those fees.
Plaintiffs challenged the validity of certain subsections of Suffolk County Code § 818-78(A). Those provisions authorize the Suffolk County TPVA to impose various administrative and late fees on people convicted of traffic and parking violations. The County moved for summary judgment dismissing the complaint. The Supreme Court, Suffolk County, denied the motion, and the Second Department affirmed.
The appellate court held that there are triable issues of fact as to whether the challenged fees are reasonably necessary to cover the TPVA’s relevant operating costs, or whether they are instead used to defray the general cost of other governmental functions or are otherwise excessive. In short, the legality of these extra fees remains an open question that must be resolved at trial or through further proceedings.
Why This Matters for Suffolk County NY Speed and NY Traffic Ticket Cases
Many motorists treat a Suffolk County traffic ticket as a simple “pay the fine and move on” matter. In reality, the total amount due often includes surcharges, administrative fees, and late penalties that can significantly increase the cost of the ticket. The Ballato decision confirms that those extra charges are not automatically immune from challenge.
Practical points for drivers:
Base fines for speeding, cell-phone use, stop-sign violations, and other common tickets are only part of the story.
Administrative and late fees imposed by the Suffolk County TPVA can be scrutinized when they appear to go beyond the actual costs of operating the Agency.
Successful challenges (or even the existence of pending litigation) can affect settlement negotiations and plea discussions.
