Rear End Accident - Police Caused Injury

In Joel Abreu Perez v. County of Nassau, Nassau Inter-County Express, Transdev Services, Inc. and Sidney Han (2025 NY Slip Op 35448[U]), the Supreme Court, Nassau County (Solages, Jr., A.J.), granted summary judgment to the County of Nassau and Nassau Inter-County Express and dismissed the plaintiff’s complaint in its entirety. The decision, issued January 14, 2025, arose from a November 16, 2020 traffic incident involving a near-miss collision and injury to motorists on Nassau Road near Northern Parkway.


Plaintiff was a passenger on a Nassau Inter-County Express bus operated by defendant Sidney Han. A pickup truck in the left lane suddenly merged into the path of the bus without signaling. Han braked abruptly to avoid a collision. Plaintiff alleged that the sudden stop caused him to be jerked from his seat and sustain injuries. Defendants moved for summary judgment under the emergency doctrine, submitting the bus driver’s affidavit and dashcam footage. Plaintiff opposed, arguing the driver was speeding or driving recklessly, should have anticipated the merge, and that further discovery was needed.


The court held that defendants met their prima facie burden under the emergency doctrine. The dashcam footage clearly showed a pickup truck suddenly merging in front of the bus without signaling, leaving the bus driver with little or no time for deliberation. The video also demonstrated that the bus was traveling under 25 mph, remaining within its lane, and not being operated recklessly.

Plaintiff failed to raise a triable issue of fact. Claims of speeding or reckless driving were contradicted by the video evidence. Arguments that the driver should have anticipated the unsignaled merge, or that the emergency doctrine’s applicability presented a jury question, were rejected. Discovery-related objections were also denied, as those issues had previously been addressed by the court.


Under New York’s emergency doctrine, a driver faced with a sudden and unexpected circumstance that leaves little time for reflection will not be held liable if the actions taken are reasonable and prudent in the emergency context. The court found that standard satisfied here.


Sudden-stop and emergency-doctrine cases involving buses, commercial vehicles, or passenger claims are highly fact-specific and frequently resolved on summary judgment when clear video evidence exists. The presence of dashcam footage can be dispositive — either supporting or defeating liability — depending on how the evidence is presented and opposed.
